Right of Withdrawal

1. Introduction

This Right of Withdrawal ("Policy") outlines the terms and conditions governing your right to withdraw from a contract entered into with Cosmic Grading Service ("we," "us," or "our") for the purchase of goods or services through our website ("Website"). This Policy is in accordance with European Union Directive 2011/83/EU on consumer rights ("Directive") and any applicable national laws implementing the Directive.

2. Right of Withdrawal

2.1 Exercise of the Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire 14 days from the day of:

  • In the case of a sales contract: The receipt of the purchased goods by the customer.

2.1.1 In the case of a service contract: By submitting your goods to be graded, you acknowledge and agree that your 14-day withdrawal right is waived, as the receipt of your submission initiates the commencement of the services we offer, thereby immediately extinguishing your right of withdrawal.

2.2 How to Exercise the Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post, fax, or email). You may use the attached withdrawal form template, but it is not mandatory. You can also electronically fill in and submit the withdrawal form or any other unequivocal statement on our Website [insert link to withdrawal form page]. If you use this option, we will communicate to you an acknowledgment of receipt of such withdrawal without delay.

2.3 Effects of Withdrawal

If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of standard delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

3. Exceptions to the Right of Withdrawal

Please note that the right of withdrawal may not apply to certain types of goods and services, as specified in the Directive. These exceptions may include:

  • Goods made to your specifications or clearly personalized.
  • Sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
  • Goods which are, after delivery, according to their nature, inseparably mixed with other items.
  • Please be aware that any discrepancies or errors in the 'CGS label' do not qualify for a refund; however, we are committed to promptly rectifying label errors at no additional cost to you.
